1. Introduction

These Terms of Service (“Terms”) are entered into by and between you (“you” or “User”) and Hangzhou Xinglu Network Information Technology Co., Ltd (“AI Filter Lab,” “we,” “our,” or “us”) regarding your use of our mobile applications, websites, and related services (collectively, the “Service”).

Please read these Terms and our Privacy Policy carefully before using the Service. These Terms contain important information about your rights and responsibilities, limitations of liability, and dispute resolution.

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY STOP USING THE SERVICE.

We may revise these Terms from time to time. When we do, we will update the “Effective Date” above. Continued use of the Service after any updates indicates your acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the involvement and consent of a parent or legal guardian.

3. Use of the Service

3.1 You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal and non-commercial purposes in accordance with these Terms.

3.2 You agree not to:

  • Modify, reverse engineer, decompile, or disassemble any part of the Service;
  • Upload any unlawful, infringing, or harmful content;
  • Interfere with the normal operation of the Service;
  • Use the Service in violation of any applicable law or third-party rights.

3.3 We reserve the right to suspend or terminate your access if you violate these Terms.

4. AI Features & User Content

4.1 You may upload images to apply AI-generated filters. Uploaded images are temporarily stored and processed to deliver the Service and are deleted shortly after processing.

4.2 You retain ownership of your original content. By uploading, you grant us a limited license to process and use your content solely to provide the Service.

4.3 You are solely responsible for any content you upload and agree not to submit content that:

  • Infringes others’ intellectual property or privacy rights;
  • Contains nudity, violence, hate speech, or illegal material.

4.4 AI-generated content is intended for personal use only and may not be used commercially without the appropriate rights or licenses.

5. Subscription and Payment

5.1 AI Filter Lab offers paid subscription plans (weekly, monthly, annually) through the Apple App Store. Prices and available features may vary by country or region.

5.2 Subscriptions are auto-renewable and are billed weekly, monthly, or annually depending on your selection. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.

5.3 Your iTunes Account will be charged for renewal within 24 hours prior to the end of the current period. Subscriptions can be managed, and auto-renewal turned off, in your iTunes account settings.

5.4 Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription.

5.5 We do not process payments or refunds directly. All transactions are handled by Apple. Please refer to Apple’s App Store policies for billing and refund terms.

6. Ads and Analytics

6.1 The Service may display ads via third-party ad networks, such as Google AdMob and AppLovin. We do not control or endorse third-party ad content.

6.2 We use analytics and crash reporting tools (e.g., Firebase, Google Analytics) to improve the Service. For more details, please refer to our Privacy Policy.

7. Intellectual Property

7.1 All content and materials provided through the Service—including software, designs, filters, interface, and trademarks—are owned by us or licensed to us and are protected by intellectual property laws.

7.2 You may not reproduce, distribute, or create derivative works based on the Service without our prior written consent.

8. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • Any indirect, incidental, or consequential damages;
  • Any loss of profits, data, or business;
  • Any delay or failure due to force majeure or factors beyond our control.

Our total liability for any claim shall not exceed the amount you paid (if any) for use of the Service within the 12 months preceding the event giving rise to the claim.

9. Termination

We may suspend or terminate your access to the Service if you violate these Terms or engage in harmful or unlawful behavior.

You may stop using the Service at any time and delete the app from your device.

10. Governing Law & Dispute Resolution

These Terms shall be govered by the laws of the jurisdiction in which you reside or are located, unless otherwise required by applicable laws.

Any disputes arising out of or relating to the Service shall be resolved through amicable negotiation. If unresolved, such disputes may be submitted to a competent court or arbitration body in accordance with local law.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

13. Indemnification

You agree to indemnify and hold harmless Hangzhou Xinglu Network Information Technology Co., Ltd and its officers, affiliates, and employees from any claims, damages, losses, or expenses resulting from:

  • Your breach of these Terms;
  • Your misuse of the Service;
  • Your violation of any law or third-party rights.
